Criminal litigation refers to the process of trying a criminal defendant in a court of law. Criminal litigators come in two varieties: criminal prosecutors, who present the government's case against the defendant, and criminal defense attorneys, who represent the interests of the defendant.
Why do we do criminal litigation?
Civil litigation is a private lawsuit between two parties, while criminal litigation is litigation brought by the state against an individual. Criminal trials require the highest standard of proof, which means the prosecutor, must prove all elements of the crime beyond a reasonable doubt.
